Rajasthan HC Resumes Physical Functioning Amidst the COVID-19 Pandemic

The Jaipur bench stated that the Court cannot delay the judicial proceedings any more and has decided to resume functioning starting from yesterday (August 31).

Facts

The Jaipur Bench of the Rajasthan High Court has declared the reopening of physical hearings at the Court from August 31.

Virtual hearings of cases at both the Jaipur and Jodhpur bench of the Court will stay over the Jitsi Meet application instead of Cisco WebEx, the Court’s communication informs. The Notice lays down a detailed Standard Operating Procedure for virtual hearings over the new app.

Arguments

The situation was turning grave day by day, but still, Rajasthan High Court will continue to work with all the courts, however for the safety of all and to limit the crowd in court premises, the hearing was limited to urgent matters of all categories. They also kept filing counters operational for new cases.

The goal of ensuring access to justice for all during COVID-19 pandemic could be achieved with the collective endeavours and input of Hon’ble Judges, Judicial Officers, Registry Officers, Bar Associations, Advocates and Court Staff.

Court Observation

The Jaipur Bench of the Rajasthan High Court has announced the restoration of physical hearings at the Court starting from yesterday.

Virtual hearings of cases at both the Jaipur and Jodhpur bench of the Court will continue through online application in the near future in addition to physical hearings. The Court’s communication has informed this. The Notice lays down a detailed Standard Operating Procedure for virtual hearings over the new app.

The Jaipur Bench of the Rajasthan High Court has also notified that a drop box will be placed outside the main entrance of the New Court Building for Counsel/Parties to file urgency memos for their cases.

Because of restricted mobility, lawyers and litigants were not able to come to Court for physical filing. Therefore, the online filing was allowed even though email d the dedicated portal was provided for filing applications for urgent listing. Simultaneously, technical tasks were started at for proper institutionalized e-filing.

Decision

Therefore Virtual hearings of cases at both the Jaipur and Jodhpur bench of the Court will continue over online means along with physical, the Court’s communication informs. Earlier online hearings were limited to a critical and urgent matter; now, however, every case will be taken into consideration as justice cannot be delayed any longer. Thus the decision of resumption was taken.
