Delhi High Court: Delhi Rozi Roti Adhikar Abhiyan files plea seeking Compulsory Enrolment to Aadhar under NFSA to be ruled Unconstitutional

During the time of distress caused by the ongoing lockdown, widespread violations were recorded in the implementation of the NFSA, including the shutdown of ration shops during working hours, denial of access to food grain and other key resources and failure to enforce the requisite grievance redressal and accountability mechanisms, having a detrimental effect on the life of a large number of citizens for their sustenance and survival.

Moved by Delhi Rozi Roti Adhikar Abhiyan, the petition was submitted for, inter alia, quashing the notice given by the Union of India on 08.02.2017, effectively requiring the production of proof of possession or proof of enrolment to Aadhar for access to subsidized food grains under the National Food Security Act, 2013, for being ultra vires the Constitution and said NFSA.

In consideration of this, the Petitioner asked the court to direct Delhi Government to set up and formulate the accountability and grievance redress mechanism as provided for in Sections 14, 15, 16 and 28 of the National Food Security Act, 2013 to ensure that no one goes hungry for lack of food and denial on any technical ground.

The present application also seeks a direction to continue providing children with the mid-day meals under the National Food Security Act, 2013 so that their right to adequate nutrition during this time of crisis is not affected.

Besides, the information like stock at ration shop, timings and functioning, stock available and other related things must be widely disseminated through boards at ration shops, display of posters and public announcements in low-income settlements in local languages.
