This group of positions is responsible for the delivery and administration of legal services to ensure the issues of risk and governance within the business are aligned to corporate goals. Assess and manage legal risks faced by various TCL entities, including legal risk assessment for new product launches, extending operations in new geographies, cross-border telecom deals etc. Provide legal assistance to Board of TCL and TCIPL for information requests. Provide advice and legal expertise to BUs for resolution of disputes around litigations and arbitrations, police cases, statutory filings, licensing requirements, audit findings, business investment roadblocks, land disputes, accounting and taxation, etc. Supervise outside counsel in processing all court proceedings (including arbitrations, mediations and tribunals) around the world. File new patent applications as appropriate and manage existing patent portfolio. Oversee all trademark activity. Support Tata Sons’ trademark applications and trademark litigations. Conduct legal research and analysis on selected topics, prepares memoranda, position papers upon request. Resolve complex and general commercial transactions. Act as main liaison point for banking and financing transactions. Monitor filing and closure of claim settlements. Prepare quarterly litigation report for presentation to Board. Draft contracts and negotiate. Build and supervise a “legal help desk” of experienced attorneys to handle global transactions of day-to-day commercial matters relating to the sale of voice, data and mobility services as well as procurement matters. The function ensures adherence to regulatory requirements by constant updation of internal systems in line with evolving regulatory requirements.
Level Descriptor
Lead a team of legal professional to drive execution of litigation/compliance related issues at the corporate/regional level. Develop and implement appropriate litigation policies, review and negotiate commercial agreements, provide expertise to legal analysts. Advise the business on all disputes and potential disputes with third parties. Monitor adherence to regulatory requirements; Monitor constant updation of internal systems in line with evolving regulatory requirements; Tactical role which provides a marked contribution to defining the direction of policies, agreements processes, standards or legal plans based upon business strategy, with a significant mid to long term impact on business unit overall results. Identifies problems and significantly improves, changes or adapts existing method and techniques. Focus is on implementation and control as well as Strategy formulation
Education : PJ.D., LLB, LLM (or a foreign equivalent) with admission to the bar in at least one relevant jurisdiction
Experience :8-10 years post-qualification experience, gained in both private practice and in-house
Purpose – Broad objective of the role

1.    should be qualified LL. B/LL.M from the recognised university of India with 10 to 12 years post qualification experience in litigation, legal matters Govt Liaoning preferably in telecom sector.

2.       Should be confident/ a solution provider, with a  pro-active approach.

  1. Should possess strong organizational skills.

4.       Should possess prior experience in litigation in Indian district courts and High Courts. Experience in pre litigation matters (like issue of legal notices, drafting of complaints, filing of FIRs, etc.) is a must. Experience in commercial arbitrations will be an  added qualification.

5.       Should have a good  experience in briefing counsel, law firms, etc. and should also be well versed with court procedures.

Minimum qualification & experience
Key responsibilities

1.       Responsible for handling/managing litigation and pre litigation matters. 

2.       Attend court matters on regular basis, monitor  litigation,  etc. 

3.       Advise internal customers on litigation / potential litigation, issues, prospects of the Company in a litigation/potential litigation, course of action, etc.  

4.       Carry out legal analysis of pending/ongoing/potential  cases.

5.       Prepare litigation briefing material for the  counsel, brief the counsel, and effectively liaise with law firms and advocates.

6.       Timely identification and intimation of legal risk to the reporting manager/management

7.       Liaise with government/non-government departments, police , etc.

8.       Timely updation of litigation MIS, preparation of  litigation reports, etc.   

9.       Implement litigation process and policy of the company.

10.   Work closely with legal team and also cross functional team.

11.The candidate should possess a polished personality, should be great communicator, must be good in creating and managing  network with government authorities and possess required skill sets to manage external environment.

12.The candidate should possess hands on experience of liaison with government authorities, knowledge and experience of Government working, he/she should be able to establish and  maintain government relations, Public Affairs, Public Relations.

13.It would be an added qualification if the candidate has experience of working on automated tools like litigation tool, compliance tool, etc.
