About the Webinar

Topic: Transformative Constitutionalism

The jurisprudence of the Supreme Court of India, particularly in the contemporary times has given currency to the coinage of Transformative Constitutionalism. This concept accords transformative role to the Judicial Institution. Though conventionally social reform has been perceived to be the function of the representative legislature, yet legislations being an embodiment of the majoritarian voice are often structured on the silencing of individual narratives.

The class so substantively disadvantaged tries to seek refuge in the judicial institution. Through creative interpretation of the Constitution, the judiciary finds an opportunity to emancipate such disadvantaged class by recognition of their substantive rights. The narratives build around the experiences of sexual minorities; experiences of women who face multiple disadvantages, for example stand testimony to this.

Thus the judiciary becomes a tool through which the Constitution can be envisaged as a transformative document. What has the Supreme court of India’s experiment in Transformative Constitutionalism been thus far, what were the missed opportunities, what are the challenges ahead and how can transformative constitutionalism help us in re-imagining a more egalitarian society, some pondering on the issues becomes an abidingly rewarding project for a legal scholar.
