The Trump Administration to the U.S. Supreme Court: “End Obamacare”

What looks like a move to wipe out the remnants of the Obama’s regime, Donald Trump has called for the elimination of Obamacare. 

What is Obamacare? 

Obamacare is a landmark law formally known as the Affordable Care Act (ACA). It had insured the health of tens of millions of Americans under Barack Obama’s regime. Under the scheme, it’s mandatory for the Americans to buy health insurance. This is unless they want to face a tax penalty. But in 2017, people who failed to subscribe were exempted from paying the fine. It was called the individual mandate. A symbolic part of the policy by the former U.S. President was chalked out.

The Fate of Obamacare 

On June 25, the Donald Trump’s administration asked the U.S Supreme Court to nullify Obamacare. The Republican-led U.S Congress had rendered the act invalid after hewing parts of it. This is the third blow to this law, at the hands of the U.S President. 

The challenge comes amidst the pitiful state of affairs in the country. Some of the highest COVID-19 infections have plagued the U.S., ever since the contagion hit it. The Trump administration had insinuated earlier about its intentions. Since his 2016 campaign, Trump had been promising to supersede the scheme, bringing in a new plan. A significant political battle seems imminent in this year’s presidential election.

The Department of Justice (DoJ) contends, “the individual mandate is not severable from the rest of the Act.” The mandate is unconstitutional following the Congress’s eradication of the fine for non-compliance. Further, the DoJ in a late filing said that the Act should be annihilated.

The Following Backlash

Nancy Pelosi, the Democrat House Speaker has castigated the move. Condemning the current administration, she labelled it as “an act of unfathomable cruelty”. Especially in the middle of the global pandemic. 

The illegalization of the Act will devoid almost 130 million Americans of the protection. Moreover, a population of 23 million could be left uninsured. Calling the act “disastrous”, Pelosi said that it had no legal or moral foundation. America is being ripped off of its healthcare, she claimed. 

Joe Bidden, the democratic presidential candidate also called Trump’s efforts “cruel” and “callous”. The graph of the Coronavirus never saw a flattening curve ever since it hit its peak in the country. Overturning the law will be like abandoning the citizens.

The Hearing 

The U.S Supreme Court has listed the case for its next term, in the beginning of October. Yet, as per the U.S. media, it will not be until the presidential election in November before which the case is assessed.
