Punjab and Haryana HC Directs Chairman of PSPCL to Dispose Appeal Filed Before Him by Petitioner

On 21st August 2020, the High Court of Punjab & Haryana heard the case of Sukhwinder Singh v Punjab State Power Corporation Ltd, Patiala and Ors. A Single Judge Bench of Hon’ble Justice H.S. Madaan heard the said case through video conferencing.

Brief Facts of the Case 

The Petitioner Sukhwinder Singh was working as an Assistant Lineman with the Punjab State Power Corporation Ltd, Patiala. Being involved in a criminal case, the Petitioner was under suspension and subsequently convicted. He challenged the said conviction and sentence. The departmental proceedings initiated against him resulted in his dismissal. As a consequence, he filed an appeal against the Order passed by the Addl. Superintending Engineer which is still into consideration and is not yet decided. This has caused prejudice and harassment to the Petitioner.

In the present Petition, the Petitioner has pleaded to get a direction issued by this Court for the Chairman of Punjab State Power Corporation Ltd, Patiala to decide the appeal. 

Court’s Decision

After hearing the learned counsel for the Petitioner, the Court decided that the appeal and request presented by the Petitioner deserve to be subsequently accepted. Therefore, the Court disposed of the Petition and directed the Chairman of Punjab State Power Corporation Ltd, Patiala to dispose of the appeal filed by the Petitioner before him, challenging the order of his conviction and dismissal within three months from the date of receipt of copy the instant Order.

The Court, further, stated that the Petitioner may submit a certified copy of the Order to the Chairman. Further, they assured that the Registry shall also send a copy this Order to the Chairman if necessary for compliance.
