Orissa High Court Grants Bail to Complete Father’s Last Rites Ceremony

Rakesh Kumar Barada made an application for interim bail on the ground of his father’s death.

Facts of the Case

The petitioner filed an application for bail. His father had passed away on 12.06.2020 and he is his father’s only son. Hence, he had to be present in all the cremation rituals according to the Hindu tradition.

Petitioner’s Submission 

The petitioner submitted the death certificate issued by the Sarpanch dated 12.06. 2020. In addition to this, he submitted a formal statement, documents, and instruction from Gangapur Police Station. He submitted these documents to substantiate his request. 

Court’s Order

The Court decided that the petitioner shall be released on interim bail from 20.06.20. Subsequently, he has to surrender before the learned Additional Session Judge on 29.06.2020. The Court set aside a bail bond of Rs 20,000 with two local sureties as compensation of the Trial Court.
