Delhi High Court Gives Directions Regarding the Re-Filing of Medical Oxygen

The High Court passed an order on 23.04.2021 regarding the re-filing of the Medical Oxygen stating that all hospitals and nursing homes in NCT of Delhi are to approach Nodal Officer, Mr. Udit Prakash. In addition to this , a Virtual Central Control Room which was set up in 2020 has been further strengthened to monitor the availability of medical oxygen. 

Facts of the Case

A Petition was filed by the Appellant to seek urgent and immediate relief for the supply of medical oxygen for the treatment of serious COVID patients. 

Arguments placed before the Court

The learned counsel appearing on the behalf of the Respondent submitted that so far as the supply of medical oxygen in cylinders is concerned, the GNCTD has issued an order dated 22.04.2021. This order enlisted the names of re-fillers with contact numbers of the Nodal Officers who may be contacted for refilling of gas cylinders. The learned counsel for the Petitioners submitted that his client has approached the refiling unit i.e. Paramount Cryo Gases Mundka Delhi but was to no avail. 

Court’s Observations

The Court stated that it may be desirable to have more officers to work with Mr. Udit Prakash, Special Secretary, Department of Health, whose numbers should also be circulated to all hospitals and nursing homes so that the grievances concerning the shortage of medical oxygen could be attended more efficiently. The learned counsel also assured that a Virtual Central Control Room, which was set in 2020, has been further strengthened to monitor the availability of medical oxygen. 

Court’s Judgment

The Court passed an order dated 23.04.2021, stating that all hospitals and nursing homes in NCT of Delhi are to approach Nodal Officer, Mr. Udit Prakash, and such other officers whose names and numbers would be circulated for the refilling Oxygen cylinders. However, in case, the requirements are still outstanding and not met then Mr, Satyakam, ASC, GNCTD, or Mr. Rahul Mehra, learned Senior Advocate shall be contacted. Further, the Nodal Officer Mr. Udit Prakash should, without any delay, update the Virtual Central Control Room about the requirements for Medical Oxygen.
