The High Court of Delhi has directed Delhi University to issue letters to the Principals of all the colleges affiliated with the University. The court emphasizes the urgency of the matter, and requests to expedite the process of evaluating the answer sheets. So that OBE (Open book examination) results for final year students can be declared by the first week of October 2020.
Facts of the Case:
In Prateek Sharma vs. Union of India, the court is hearing issues being faced by students who are moving abroad for higher education. The issue cropped up during the hearing of a petition concerning OBE for final year undergraduate DU students. The university had earlier told the court that the results will be declared at the end of October. But the deadline fixed by a foreign university for submitting documents is September 17.
Submissions before Court:
Mr. Mohinder Rupal appeared for Delhi University. He informed the court that around 900 emails have been received by the students. The students seek comfort letters to be sent, explaining the delay in declaration of results, to both the Universities in India and abroad. And out of these, 292 requests have been sorted.
Further, Dr.D.S.Rawat, Acting Dean (Examination), Delhi University assured the court that the comfort letters shall be dispatched directly to the foreign Universities, depending on the cut-off date for compliance mentioned by the students in their e-mails.
Dr. Sanjeev Singh, Head of DU’s computer department informed the Court that 50% answer sheets that were submitted through the OBE portal have been evaluated.
Court’s Order:
The Division Bench of Justice Hima Kohli and Justice Subramonium Prasad directed that:
- For the postgraduate students seeking admissions in foreign universities, DU shall declare the results on its online portal on September 28.
- For the undergraduate students seeking admissions in foreign universities, comfort letters shall be issued to the concerned universities directly in the format decided by the Grievance Redressal Committee.
- DU shall confirm having sent the letter. And send a communication saying that the student has been provisionally passed. So that students may apply for a visa.
