Calcutta High Court: Appropriate Authority to Decide on Whether “Paatal Lok” Is Defamatory

The Petitioner approached the Court through a Public Interest Litigation. The main concern of the Petitioner is in the streaming of the web series Paatal Lok. The Calcutta High Court heard the case on 24th July 2020. The Court decided to let the competent authority rule the matter.

Facts of the Case

The Petitioner opposes the streaming of the show Paatal Lok aired on Amazon Prime. The petitioners argue that the Web Series is defamatory to the Nepali Community. The only question raised to the Petitioner is about competent authority. The competent authority is the specific authority who can decide the case. The Petitioner pointed out that Respondent No. 8 is the competent authority.

The Decision of the Court

The Court held that Respondent No. 8 should decide the case. The 8th respondent’s issues as presented were open ended, and are competent to decide the matter following the law.

Moreover, the respondent has four weeks to decide the same. The decision is to be based on merit. This also includes permission to ban the portions which are defamatory. The Court concluded with leaving the petition open-ended.
