The Supreme Court while hearing the petitions challenging the Farm Bills, on Monday showed its extreme disappointment over the way the centre has handled the situation of farmers’ protests.
It said that the centre was given enough time to negotiate with the farmers but it has not been able to solve the problem and the Farmer’s agitation, so the court indicated that it may attempt to stay the implementation of the farm laws in abeyance to make the atmosphere conducive.
The hearing was going on before a three-judge bench headed by Chief Justice SA Bobde which said,
“Tell us whether you will put the laws on hold or else we will do it. What’s the prestige issue here?”
The court slammed the centre over the farm’s protests that it should pass the laws after discussing with the stakeholder.
CJI SA Bobde told the petitioners that the court is trying to form a committee and till then it is thinking to hold the implementation of the laws. He also noted,
“We don’t want to say anything, the protests can go on, but who is going to take the responsibility?”
The Attorney General of India told the apex court that a law can’t be stayed unless the court finds it violative of the fundamental rights or the constitutional schemes and asked for more time but it was rejected by CJI.
Senior Advocate Dushyant Dave who was appearing for one of the Farmers’ Union questioned the way such important law was passed in the parliament. He said that if the centre is serious then why it is shying away from holding a joint session. He further requested the court to adjourn the matter for today i.e., Tuesday 12th January.
The Chief Justice of India SA Bobde told the 8 farmer Unions which was represented by Dave, Prashant Bhushan, H S Phoolka, and Colin Gonsalves to ask all the old men, women, and children who were there in the protests, to go back home. The CJI said,
“I am taking a risk and making a personal request. Please convey”
when he heard that they were not willing to go back.
Senior Advocate Dushyant Dave has suggested the name of Justice RM Lodha for the chairman of the committee which will decide the good and bad clauses for the farmers.
