A PIL had been filed by a law student praying for a CBI or NIA probe into the death of Sushant Singh Rajput. It was dismissed by the Supreme Court. The Supreme Court observed that the matter is already being pursued by the late actor’s father so there is no need for this petition.
Brief Facts of the Case
A law student has taken note of certain inconsistent facts and circumstances and filed a PIL in the Supreme Court via Advocate Manoj K. Mishra. The student, Dwivendra Devtadeen Dubey contends that Sushant Singh Rajput failed to match the vivacious personality of certain elements of the film industry. This made him an eyesore. He was also viewed by many as a threat or a competitor.
The plea suggests that certain elements had started a campaign against the deceased actor. They wanted to ruin his career and even snatched away a big movie from him.
The petitioner prayed for directions to the CBI or the NIA to investigate the case. Also, he requested for submission of a detailed report to the Court by the agencies after probing into the connection between Bollywood and underworld, drug lords, etc.
Arguments before the Court
Although not appearing in this case, Solicitor General Tushar Mehta mentioned that the FIR filed in Patna has already been taken over by the CBI.
The Advocate appearing for the petitioner stated that the FIR filed by the Mumbai police is not following Section 154 of the Criminal Procedure Code. He added that since the FIR in Mumbai still hasn’t been transferred, the CBI probe is limited to Bihar.
He highlighted the Mumbai Police’s unwillingness to let CBI takeover. He further said that if not transferred, there will be nothing left of the case when CBI gets to it.
Court’s Observation
First, the CJI pointed out how CBI is already on the matter hence the present plea is unnecessary. Also, since the deceased actor’s father is already on the case, there is no point in a total stranger to pursuing the matter.
The CJI also asked the petitioner’s Counsel not to make irresponsible statements.
Court’s Order
The CJI dismissed the plea when he found no grounds to pursue it. The Court stated why would a law student be interested in this case when the actor’s father is already pursuing the matter.
