Supreme Court Asks Petitioner to Approach Bombay High Court in PIL for CBI Probe in Disha Salian Case

On the 26th of October 2020, the Apex Court heard the PIL praying for a CBI probe into the death of Disha Salian. The Court granted the Petitioner liberty to approach the High Court of Bombay instead. 

Petitioner’s Submissions

Disha Salian, the manager of late actor Sushant Singh Rajput had been reported dead on the 8th of June. The reason alleged was her falling off the 14th floor of a residential building in Malad (West) Mumbai, it was said to be a case of suicide. 

Due to the subsequent death of Sushant Singh Rajput people started doubting the suicide angle to the death of Salian.

In this Petition, the Petitioner Puneet Kaur Dhanda points toward the suspicious act of the Mumbai Police. It is alleged that they informed the Bihar Police that the records of the case of Salian’s death were deleted by mistake when the latter asked for the same for investigation.

Also, when the latter wanted to help, the former refused to allow access to the laptop that had stored files related to her case’s investigation. 

The Petitioner states that there was a connection between the two deaths. He relies on a news article to argue that many celebrities were involved in the same.

The Petitioner alleges, relying on the news report that Disha Salian was called by an actor ‘star kid’ to his party in his penthouse which included a few celebrities and political personalities.

It further alleged that she was raped and molested there and immediately after this she died.

Now the plea went ahead to state that Salian informed Rajput about this incident via a phone call who in turn informed his friends, Sandeep Singh and Rhea Chakraborty. Thereafter Singh informed and alerted those involved in molesting and raping Salian.

Post this, the plea states, Rajput started receiving death threats and consequences if he opened his mouth to the cops or media. Due to this, Rajput was terrified. He would sleep in his car, and he changed his number 50 times between the 9th and 13th of June.

Petitioner’s Prayer

The Petitioner highlighting the concerns about Disha Salian’s mysterious death had prayed to the Supreme Court to seek records on the investigation from the Mumbai Police. The Petitioner also prayed for a CBI probe into the matter to find out the real reason behind the alleged suicide.

Court’s Decision

The three-judge Bench comprising of Chief Justice SA Bobde, Justice AS Bopanna, and Justice Ramasubramaniun said that the Petitioner may have a case but he should approach the High Court since they are privy to the officers and had the evidence. The Petitioner could approach the Supreme Court again if any problem arose. 

Hence the Petitioner withdrew the Petition.
