On 26th August 2020, the Supreme Court heard the case of Karthick v The State represented by Inspector of Police, Tamil Nadu. The Bench consisted of Hon’ble Justice R. Subhash Reddy and Hon’ble Justice M.R. Shah.
Brief Facts
The conviction of the Appellant was under Sections 147, 323, 325, 323 read with 149 and 325 read with 149 of IPC. For the same, he had to pay compensation of Rs 30,000 and the Trial Court gave a sentence for imprisonment for 1 year. He filed an appeal regarding the same in the High Court which upheld the order of the Trial Court. Moreover, the High Court dismissed the Revision Application filed by him, after which he filed an appeal in the Supreme Court.
Appellant’s Arguments
The learned Counsel on behalf of the Appellant submitted that the Accused has undergone a sentence of 6 months. Moreover, there was a delay of 12 days in lodging the FIR, and injuries suffered by the victims were very minor. Further, the incident occurred suddenly while plucking ‘Jamun’ which indicates that there was no prior intention to cause the injuries.
Respondent’s Arguments
The learned Counsel for the Respondent argued that the injuries suffered by the victims were grievous. He further contended that the Accused deserves no mercy for the said offences.
Court’s Judgment
The Court opined that the injuries suffered by the victims except PW3 were minor, only PW 3 had suffered grievous injuries. The Court confirmed the conviction of the Accused of the above-mentioned offences. However, the Court took note of the fact that the Accused had completed 6 months of his sentence and reduced the sentence to the period already undergone. Further, the Apex Court enhanced the amount of compensation to PW 3 by Rs 25000 which must be positively paid within 6 weeks from the date of the Judgement.
