Physical Hearing To Commence in Subordinate Courts of Punjab, Haryana, and Chandigarh

An order was passed on Friday by the Punjab and Haryana high court administration that the district courts in the states of Punjab and Haryana and UT Chandigarh will be starting physical hearing from Monday.

An order by Sanjeev Berry, the registrar general of High court states that the Chief justice is pleased to announce that all district and session courts in Punjab Chandigarh and Haryana will commence physical hearing from Monday for all cases, but will be subject to the courts own discretion taking into consideration the prevailing conditions. The prevailing conditions refer to the intensity of COVID-19 spread in a region.

The order further mentioned that while commencing the physical hearing, the guidelines/ health adversaries given by the government of India and the state government will strictly be followed.

The District and Session court judges of Punjab, Haryana, and the UT Chandigarh were directed to draft weekly reports stating the duration time of presiding officers, the number of cases, and a gist of the work done on each day.

The order further suggested consulting respective bar associations, police superintendent, deputy commissioner, civil surgeon, and other health authorities to amicably solve issues if any relating to the physical hearing of cases while adhering to the guidelines prescribed by the government.

The disposal of cases before the Punjab and Haryana High Court might speed up as the High Court administration had decided that all the cases will be taken up through virtual hearing. With the new arrangements that have been made, all the cases that were being heard on a rotation basis are now being heard through video conferencing.

This would increase the faster disposal of cases in the High Courts. It is also being said that the high court administration is preparing for a physical hearing for which prerequisite arrangements are being made.
