Facts of the Case
The Petitioner is entitled to a monthly pension under the Social Security Scheme- Indira Gandhi National Pension Scheme, for physically disabled people. But was discontinued without proper reasoning.
Arguments of the Parties
The counsel for Petitioner contended that the Petitioner is entitled to a monthly pension of Rs 1000. Furthermore, the pension is granted under SSS- IGNPS. Moreover, it was submitted that the Petitioner has multiple disabilities. Therefore, since the disabilities are continued, Petitioner is entitled to a continuous pension. Hence, the abrupt stop in dispensing of pension in February 2017 had no known reason.
Observation of Court
Therefore, the Court observed that Petitioner is entitled to a pension under the scheme. As for the stopped pension from February 2017, the Court directed the respondent:
1. To pay the pension continuously to the Petitioner as earlier.
2. To calculate the arrears of pension from February 2017.
3. The pension with arrears should be paid to Petitioner within two weeks from receipt of the notice.
4. Delivery of the arrears of pension to the doorstep of the Petitioner.
Decision of Court
Thus, the Court disposed of the petition with directions to the Respondents.
