Gauhati High Court Orders For Assistance to Sex Workers During Pandemic

A Public Interest Litigation has been filed by Sri. Debajit Gupta raising the concern over the present condition of sex workers. This application has been filed calling for a relief fund for the sex workers of Assam.

Facts of the Case 

The Petitioner states that the sex workers of Assam already live in very unfavourable conditions. In most cases, they are on the verge of starvation. Adding to these strange times of pandemics, their conditions have worsened. Learned counsel for the Petitioner has placed before this Court an order of the Honourable Apex Court dated 29.09.2020. where while managing a similar issue as are before us in this appeal, certain headings were given by the Apex Court regarding alleviation and help that is to be given to sex labourers during the present COVID-19 pandemic.

In compliance with the order dated 27.05.2021, learned counsel for the Petitioner had moved an impleadment application for impleading the Union of India, represented by the Secretary, Ministry of Women and Child Development as well as National AIDS Control Organization. Learned counsel for the Petitioner had encouraged that as regarding a specific area in Assam for example Cachar, a portion of the sex labourers and their relatives are especially battling in the current circumstance and quick help should be given to them as ration (rice, beats, and so forth) and different things of the day by day need.

Decision of Court

The Court stated that they have been informed that Deputy Commissioner, Cachar has already identified these sex workers and their families, since a project is being run under the Deputy Commissioner, by the National AIDS Control Organization. Since it’s a concern to be dealt with urgently, the court approved the ration to be provided by today (01.06.2021) itself.

Court’s Decision 

The Court identified this issue as a matter of urgency since there had been several instances identifying this issue faced by sex workers of Assam. Hence without a delay, the court ordered to analyze the previous information achieved through the works of Deputy Commissioner, Cachar, and work towards providing aid to these people and their families.
