The main arguments raised by the petitioner was that the order that passed was done so without conducting any proper hearing and was, therefore, violative of the principle of audi alteram partem.

The court observed that “Woman has the right to put her grievance at a platform of her choice even after decades. A woman cannot be punished for raising voice against sex abuse. Right to reputation cannot be protected at the cost of the right to dignity.”

One accused in the case was Danish, a cab driver who was charged for being a conspirator of the violence. Danish was arrested on March 11th 2020. The said matter is with respect to a bail plea for Danish.

The recent incident of a youth suiciding over losing money through online gambling was one of the triggers for the filing of the PIL. The petition pointed out the Kerala Gambling Act, 1961 did not cover online gambling as its provisions did not include online activities in its scope.
