Supreme Court Agrees to Permit 30 Personnel from LG Polymers to Access the Chemical Plant At Vizag

The Supreme Court has agreed to allow 30 people from LG Polymers access to the chemical plant where the Visag Gas Leak Tragedy occurred on May 7, which left many people dead and injured.

Brief Facts Of the Case 

The Visakhapatnam Gas Leak, or the Visag Gas Leak was an industrial accident that occurred at the LG Polymers. The incident took place at R.R.Venkatapuram village near Gopalapatnam on the outskirts of Visakhapatnam on the early morning of 7th May 2020.

Company has filed and appeal before the Supreme Court against the NGT order which coordinated of 50 crores by the organisation and framed an advisory group to ask into the disaster. 

National Green Tribunal Act, 2010 is an Act of the Parliament of India which enables creation of a special tribunal to handle the efficiency disposal of the cases of environmental issues.

National Green Tribunal and multiplicity of committees, had raised before the Supreme Court, the Apex Court refused to intervene in the matter and directed them to raise their contentions before the NGT instead.

Contentions of the Respondent

The Temperature of the plant cannot be allow to go beyond 25 ‘C and if by any chance because of lack of adequate attention is safety measures, if the temperature goes beyond 25`C situation can have some ill effects. At least 28 technical personel officials must be give emergency access to the plant at any given point. So, that adequate measures are undertaken round the clock.

Contentions of the Petitioner

The Emergency access and the toxicity of Polymers highlighted and there were issues of multiplicity of monitoring committees. The Petitioner’s were told to give a list of 30 personnel who may have been granted access to the plant.

The NGT has constituted a five member Committee to inspect the site and submit a report to it within ten days.

Held

The Supreme Court said that though, they see force in the submissions, considering the fact that the compliance report directed to the filed by 26.5.20, the matters may taken on 27.5.20 and 28.5.2020, and that liberty is given to the petitioner to place all these issues.

The bench directed LG Polymers India Pvt. Ltd. to deposit a sum of Rs. 50 Crore, with the District Magistrate, Vishakhapatnam.

The Supreme Court had then ordered LG Polymers to make these submissions before NGT on May 30.
