The three-judge bench comprising of CJI SA Bobde, Justice L Nageswara Rao and Justice Sanjiv Khanna presided over this matter. They refused to review its order passed in the case Anuja Kapoor vs. Union of India & Ors.
Brief Facts of the Case
The authenticity of information is a long-standing issue in the society. The petitioner Anuja Kapoor had filed a writ petition in 2019. It highlighted the issue of fake news and sought guidelines to curb the same. She informed the Court about the fake news on social media during the Indo-Pak tension. In light of this issue, there were videos and pictures of previous airstrikes peddled as the latest ones.
“The intensifying tension between India and Pakistan since Tuesday’s airstrike has turned the social media into a virtual battlefield. Fact-checkers are left grappling with fake news”, the petitioner asserted in her petition.
Furthermore, she sought to issue directions to the concerned ministries for forming a committee to curb fake news. The petitioner contended that fake news was leading to various violent incidents. These included mob lynching, communal riots, sedition, etc.
“Fake news is a menace. It should be stopped. Thereby, the top court should pass appropriate guidelines on the issue. The Apex Court should direct the UOI to frame rules to stop circulating fake news,” the petition read.
But in April 2019, the Court dismissed the writ petition. A three-judge bench headed by CJI Ranjan Gogoi noted that the writ petition was devoid of merits. Aggrieved by the decision, she filed a review petition against the order of dismissal.
Court’s Order
The Bench opined that they do not find any ground to entertain the review petition. As a result, it dismissed the review petition.
