Plea in Supreme Court: Test Centre for NEET in Foreign Countries or Postpone Exams Till COVID-19 Subsides

The Plea sought for allocation of exam centres in foreign countries. Alternatively, it was prayed for the postponement of the exam until the pandemic ends.

Facts of the Case

The Kerala High Court dismissed a similar plea on 30th June 2020. This was on the ground that the Court cannot give directions to expert bodies. The body here in question was the
Medical Council of India.

The parents of the applicants for NEET-UG 2020 live in Doha, Qatar. They challenged the High Court’s dismissal of the Plea. MCI submitted in the High Court that overseas test centres are not practical. Rather, the students could return to India following the guidelines issued.

Advocate-on-Record Pallavi Pratap filed the Petition in the Supreme Court. This was on behalf of the parents of the applicants for the NEET- UG 2020. The Petitioner submitted that 4000 students have enrolled for the exam. These 4000 students are from Qatar and Middle Eastern countries. The Indian embassy in Qatar is unable to attest the documents. This results in problems for the students.

The Petitioner submitted that there has been a ban on international travel by MHA due to COVID-19. Due to this, it is not possible for the students to give the exam in India. Before
the commencement of the pandemic, the students were ready to attempt the exam in India.

International Flights have started its operations through the Vande Bharat Mission. But seats were not available to the students.

The Plea stated that, “It is primarily because the VBM flights are mainly intended to repatriate the people who are in distress, migrant labourers, people who are in a medical emergency, as also students stranded in various universities abroad.”

Prayer

The Petitioner prayed for allocation of exam centres in foreign countries. Alternatively, he prayed for postponement of the exam until the pandemic ends.
