Uttarakhand High Court directs the Government to install Ventilators in Hospitals dedicated to Covid-19 treatment

Two writ petitions were filed in the Uttarakhand High Court seeking installation of proper medical equipment in hospitals which had patients battling the COVID- 19 pandemics. The petition also demanded the protection of the doctors, nurses and the paramedics who were in the frontline of this battle.

In its Match 2020 order, the Government of India had categorized three types of hospitals: COVID care centres, dedicated COVID Health Centres and dedicated COVID hospitals. The present petition was mainly concerned with dedicated COVID hospitals. The petitioners stated that certain dedicated COVID hospitals did not have ventilators and an ICU which are mandatory facilities to the provided by such hospitals in case of contingency.

The bench consisted of Justice Sudhanshu Dhulia and Ravindra Maithani. It was categorically noted by the bench that even though there was a shortage of ventilators, the principal requirement of such a hospital was to have a ventilator facility. The bench directed the state government to install one or two ventilators in these hospitals within one week from the date of the order. The State Government was also granted the liberty to bring to the notice of the Court any suitable correction/review in case any practical and logistical problem which arose with the compliance of the order.
