Telangana HC Grants Two Days to Convey the Decision of Appropriate Notification and Counselling to the Higher Secondary Department

In Telangana Republican Party Trp vs The State Of Telangana, on 18 January 2021, Telangana High Court directed the Higher Education Department for passing suitable orders for permission to the Telangana State Council for Higher Secondary to issue the appropriate Notification and to conduct counseling.

Brief Facts of the Case

The present petition has been filed by the petitioner praying inter alia for declaring the action of the respondents No.2 and 3 of conducting TSICET-2020 (Admissions) Institutional spot admissions into MBA and MCA courses, without taking any steps to announce the supplementary examination results of the first to fifth semesters, thus depriving the students of an opportunity to obtain admission into MBA and MCA courses, as illegal and arbitrary.

Submission of the Respondents

Ms. P. Sharada learned counsel for the respondents No.2 and 3 states that her clients had submitted a letter to respondent No.1/Special Secretary, Higher Education Department on 04.01.2021 for passing suitable orders for permission to the respondent No.2/Telangana State Council for Higher Education for issuance of appropriate Notification and conducting counseling, but the said letter is still pending at the end of the respondent No.1.

Ms. C. Vani Reddy, learned counsel for respondent No.1 states that the aforesaid letter was received by the Department only on 08-01-2021, which is also ten days ago. However, the file is stated to be still in circulation.

Order of the Court 

The Court granted to respondent No.1 two days to convey its decision to the respondents No.2 and 3 on the aforesaid aspect raised in the letter dated 04-01-2021, failing which this Court will be inclined to pass adverse orders against the respondent No.1 including imposing costs.
