Telangana HC Directs the Government to Take Quick Action in Matters of Illegal Construction

Telangana High Court on 25.08.2020 directed that at least regarding the illegal construction, the Government should take quick action in the matter of the public interest litigation filed by S.Narsimha Reddy.

Prayer of the Petitioner 

The petitioner seeks to demolish the illegal construction work. He also seeks to extend work carried out by the Government. 

Submission of the Petitioner 

The illegal construction work of multi-storied building works is going on. The green belt area has been removed. The drainage system has been demolished in the Rajiv Gruhakalpa Housing Project.

Submission of the Respondent 

Special GP attached to AG P. Radhive gives information to the Court. The information is regarded as the veracity of the allegation. It needs some time to get instructions from the concerned departments. Later on, we will file a counter-affidavit.

Observation of the Court 

The High Court Division Bench comprising Justice A. Raja Shekar Reddy. Justice Bollam Vijaysen Reddy is also a part of the Bench.

The Bench showed dissatisfaction over the request. He said that it is not that every time the Court should give direction. The Government should be quick enough, at least in such matters. The Government should take immediate action in the matters of illegal construction. And then they should come back to the Court.

The Bench pointed out that by the time the authority gets instructions. Building construction will be completed, and more complications may arise. When a plea is filed, the Court has to pass the orders. And then the authority has to wait for that. When a serious allegation is made, the Government can take action. They can report to the Court that action has already been taken.

The green belt area huge multi-storied buildings are coming up. The Court cannot delay more. Buildings are constructed and allotted to the buyers. And it will lead to further complications.

The Decision of the Court 

The High Court bench issued notices to the respondent Government departments. The Court directed the registry to list the matter on September 1.
