The Government of Maharashtra approved and sanctioned an allowance of Rs. 50,000 per annum. It is an astonishing move. This allowance is for judges of the Bombay High Court and their families to buy spectacles.

Introduction

A government resolution dated July 10 issued by the Law and Judiciary Department stated that the amount determined for covering the cost of purchase of glasses/eyewear is dependent on them. Symptomatically, the judges, their spouses and other family members are dependent on them. As a result, Legal Advisor and Joint Secretary Yogesh Ameta signed it.

Content of Resolution

The government resolution states:

“Now, under this Government Resolution, approval is hereby granted to purchase spectacles/spectacle for the Hon’ble Judges of the Bombay High Court and their spouses and their family members dependent on the Hon’ble Judges, in the maximum limit of an amount of Rs.50,000/- every year jointly or severally and for the recurring expenditure to incur, therefore.

The expenditure incurs, therefore, shall debit under the Account Head ‘Demand No. J-1, 2014 Administration of Justice (00), 102 High Courts (01)(01) Judges (Mandatory)(2014 0065) 13 office expenditure’ and shall be defrayed from the grant sanctioned for the concerned financial year.”

Court’s Observation

The Court observed the resolution, saying that the resolution is in concurrence with the Finance Department dated June 24, 2020. Moreover, the resolution is under the approval dated July 10, 2020, of the Competent Authority. Hence, the purchase policy must be as prescribed by the government from time to time as the resolution describes the policy of purchasing.
