Rajasthan High Court Resumes Normal Functioning On 29th June

The Rajasthan High Court decided to begin regular functioning from June 29 onwards.

Facts of the Case 

In light of the recent relaxation in the lockdown, the Rajasthan HC will begin its normal functioning. All the benches of the Court will begin their regular functioning.

Main Observations

It was contended that normal functioning should resume but certain alternatives should remain. These alternatives included video conferencing and other digital mediums of filing. Certain restrictions were also imposed. The Court will take various steps for maintaining the distance, as specified in the notification.

The Court will permit manual and video conference hearing with certain conditions. It specified that manual hearing will be conducted first, followed by a digital one.

In its notification dated June 12, the Court has said that all Benches of the High Court will function. The Benches will convene at 10:30 AM and continue till 4:30 PM while breaking for an hour for lunch.The notification says that listing of matters before each Court will limit to 100 items each. The Court could revise schedule and listing restriction from time to time.

Advocates will enter the Court premises on showing an e-pass. Advocates and other Stake-holders under Quarantine are not allowed in the Court. Hence, only those Advocates will enter the premises who have to argue in the case.

The filing of written submissions in up to 5 pages ought to take place. All fresh matters can be filed manually or by e-filing. During filing matters manually, Advocates will file their-cases, documents, petitions, applications in the Stamp Reporter Section while following precautionary measures given in Government Advisory.

Court’s Observation

In light of the recent relaxation in the lockdown, the HC has deemed it fit to resume its functioning. The lockdown along with many facets of life and industry had also put a lot of strain on the Justice system. The HC went ahead and ordered in one of the recent notifications that resuming the working of the Court had put some restrictions. Further, it stated other details about the maintenance of hygiene and need for sanitization.

Decision by the Court

Thus, Rajasthan High Court decided to resume regular functioning from June 29 i.e. a few days back. The High Court has also provided norms for prevention of the spread of COVID-19, that are to be adhered to.
