Madras High Court: Two Out of Three Similar Writ Petitions Defected

A Writ Petition was filed under Article 226 in Madras High Court in the case of M/S Saraswathi Wines v. Union of India and Anr. The filing of the writ was for the issuance of the writ of mandamus. The primary need was to direct Respondent no. 1 to dispose of the appeal filed by the Petitioner against the order of 07.05.2020. Justice Dr Anita Sumanth heard the matter and disposed of the writ petition. 

Facts of the Case

By consent expressed by both learned counsel, these writ petitions were taken up for final disposal even at this stage. The primary need was to direct Respondent no. 1 to dispose of the appeal filed by the Petitioner against the order of 07.05.2020. The order was to cancel the FL2 Licenses of the Petitioner.

Arguments of the Parties

The Standing Counsel pointed out that two out of the three similar petitioners have defected. In the third appeal defect memo issued by the authority had been complied with by the Petitioner.

Observation of Court

The Court directed all the three petitions to be presented together on the same date to enable them to comply with the same. The facts and circumstances are similar to three appeals. Hence, this one is passed in the same direction as that of other appeals.

The Petitioner is permitted to approach the 1st respondent praying for early/expeditious hearing, which request, as and when filed, will be promptly considered and decided by the first respondent depending on his roster.

The Writ Petition was disposed of.
