On Monday, July 12, the Madras High Court pronounced that any further extension of interim orders beyond July 15 was not necessary for the present conditions. Through this order, it overruled a previous order of June 29 pertaining to the same matter.
FACTS OF THE CASE IN BRIEF:
Keeping in mind the rising number of Covid cases in the country, the Madras High Court in its Principal Seat, as well as the Madurai Bench, had passed orders extending interim orders until July 15. The Court had also taken into consideration that to produce remand prisoners via video calls or in-person proved to be challenging given the situation prevailing at that time. Any order of eviction, dispossession, or demolition which had not been executed as of that date stood suspended. The Advocate General also advised the State to stay any demolition or eviction listed on those dates. However, in case of extreme hardships, the aggrieved party was given the liberty to apply for discontinuation or discharge to the concerned Court. The matter was listed for further consideration on July 12.
OBSERVATION OF THE COURT:
The Bench comprising of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy observed that currently, there had been an improvement in the Covid situation. In addition to the opening up of the public transportation system, the limits imposed by lockdown had also been relaxed. In view of the current situation, there was no need for the interim orders to be prolonged beyond July 15.
COURT’S ORDER:
On June 29, the Court had released an order stating the interim orders to be carried on even beyond July 15. However, on Monday, the Court disposed of this previous order and opined that in the light of the present situation, interim orders would be in place till July 15, 2021. However, the Court had ordered not to disrupt the current suo moto proceedings so that, if there was suddenly a spike in the number of Covid cases reported or the announcement of a lockdown, then relevant measures would be taken to protect the litigant’s interests and further orders of this nature could be issued to the extent of necessity up until July 15, 2021.
