False Complaint Filed In Madras High Court for Purpose of Revenge By the Police Inspector

A petition was filed under Section 482 of CrPC, in Madras HC in the case of S. Senthamarai v. The State Representative, Inspector of Police. The petition had three requests:

  1. To accept the surrender of the petitioner/accused.
  2. Consider the Petitioner’s bail application.
  3. Grant bail on the date of surrender itself.

Justice Mr B Pugalendhi heard and allowed the matter of the petition.

Facts of the Case

The Petitioner was charged with a crime under Section 294 of IPC, 1860 r/w Section 3 of SC/ST Amendment Act 2015.

Arguments of the Parties

The Petitioner’s counsel submitted that due to the previous enmity, the police registered a false complaint. Before this complaint, the Petitioner had filed a complaint on the complainant. The complainant used to click pictures of the women who came to the pond to take a bath and fetch water. Hence, as a form of revenge, the complainant filed a false complaint against the Petitioner.

Observation of Court

The Court directed the Petitioner to surrender within six weeks from the date of receipt of the copy of the order. If he surrenders, only then the Court will consider his bail application on that same day with the accordance of the law.

Decision of Court

The Court allowed the petition.
