[COVID-19] Calcutta HC Extends All Interim Orders Due To The Non-Availability Of Access To Courts Due To Coronavirus Outbreak

The Court has submitted a petition ‘on its own’ regarding matters pending with interim orders in the High Court at Calcutta and Courts subordinate to it including the Tribunals within the State of West Bengal and Union Territory of Andaman and Nicobar Islands during the prevailing COVID-19 situation related the non-availability of access to Courts.

The Petition is under the Hon’ble Chief Justice Thottahil B. Radhakrishnan, Justice Dipankar Datta, Justice Sanjib Banerjee, Justice I.P Mukherjee and Justice Joymala Bagchi.

On 24th March 2020, the Court has decided in the exercise of the authority under Article 226 (Power of High Courts to Issue Certain Writs) and Article 227 (Power of superintendence over all courts of the High Court) of the Indian Constitution, all matters in which interim orders are subsisting as on 16th April and those which are due to expire before 9th April will be extended to the 30th of April 2020.

The order was communicated to all the Subordinate Courts and Tribunals along with the Learned Advocate General, Senior Central Government Advocate, Government of India, President and Secretaries of the three wings of the Bar and has requested that the order be circulated among lawyers, litigants and others interested.
