In the case of Secretary, Sharmistha Choudhury & Anr. Vs The State of West Bengal & Ors., the petitioner filed a PIL. The Public Interest Litigation concerns the repayment of wages to the jute industry workers.

Observations of the Court

The Two-Judge Bench of Justices Thottathil B. Radhakrishnan and Arjit Banerjee heard the petition. It took note of the plight of the workers due to the non-payment of wages.

The Court made the following observations:

  1. Firstly, it directed the State Government to enter into meaningful dialogue with workers of the jute industry. In addition to this, it directed the State to ensure timely repayment of wages to the workers.
  2. Secondly, the Court took note of the worker’s problems and directed the State to take up the matter on an urgent basis.
  3. Thirdly, it gave the State up to four weeks to complete the repayment.

The Decision of the Court

The Court took note of the urgency of the matter and disposed of the petition. It stated that the petition would serve no purpose if left pending. The Court expected the petition to act as a positive motivation for the State.

As no affidavit was called for, the Court did not admit any allegations against the respondents. However, it issued directives to ensure repayment of wages.
