Bombay HC: Maintain Status Quo on Requisition of Redeveloped Properties as Quarantine Centres

Bombay HC ordered MCGM to maintain status quo while demanding buildings for centres. This came about as the owners and occupiers of the properties were rendered homeless.

Issue

Sahyog Homes Ltd filed the petition, and counsel Nilesh Gala appeared for them. They claimed that BMC sealed its 22-storeyed SRA Building to convert it into a quarantine facility. As a result, a division bench asked MCGM to maintain the status quo in the order passed earlier. 

Findings

The circular rendered hundreds of families homeless. The families handed over their original houses to the builders. Meanwhile, they resorted to alternate accommodations. With time, the builders stopped paying monthly payments to the families. Owing to the financial difficulties, the families landed on the streets. Consequently, people in Runwal Complex, Diva, clashed with police over plans to take over a building.

Proceedings

The bench termed the circular to be prima facie “unjust and unfair.” They ordered MCGM to maintain status quo to requisition buildings as quarantine centres. The Court declared the actions of the Corporation unreasonable. The isolated families had become homeless due to this. The occupants waited for the reconstruction of the old building. Meanwhile, BMC requisitioned the multi-storeyed redevelopment building, awaiting the OC. 

Decision

The Court ordered the Corporation to file an affidavit, with details of the building. The Court also sought details of the number of beds and individuals housed therein. June 16th is the declared date of hearing of the matter.
