Andhra Pradesh High Court Issues Notice In Writ Petition Filed By Court Itself

Andhra Pradesh HC has issued notices to 26 respondents in the petition filed by the Court. Court issued notice to Centre, AP Government, Andhra Pradesh Police, and social media platforms. These social media platforms include Facebook, Google, Instagram, youtube, WhatsApp, twitter.

Petitioner’s Plea

Advocate Shri N. Ashwani Kumar is representing the petitioner. The petitioner filed this petition under Article 226 of the Constitution. The Court filed a petition to regulate defamatory posts against the judiciary.

The petition complained that several people have made defamatory posts against the High Court. It seeks direction to the police to file FIR against offenders. The Centre didn’t take any action against the FIRs filed in this matter. It urged the Court to declare the inability of the Government and AP police to take action as illegal and violative of provisions of CrPC and IT Act, 2000.

The posts criticized the HC in connection with several judgments made by it recently. In this context, the HC had earlier initiated suo moto contempt action against 49 persons.

The petition urges the Court to direct social media platforms to remove all such derogatory posts. It seeks to direct these platforms to devise a framework to prohibit the posting of defamatory content related to the judiciary. It seeks direction to the Union Government to frame intermediary guidelines. The plea highlighted that the Centre has failed to take any action in this matter. 

Chief Justice J K Maheshwari and Justice C Praveen Kumar issued notices to the respondents. The notices issued to them to seek their response about why the Court shouldn’t entertain this petition. The matter will be next considered after three weeks.
