Allahabad HC Directs the CJM of Etah to inquire into the incident of Lawyer’s Assault by UP Police

The Allahabad High Court on Tuesday directed the Chief Judicial Magistrate, Etah to look into the incident of the assault on the lawyer by the Uttar Pradesh Police.

The court has taken Suo moto Cognizance of this incident and the case was listed to be heard today before the bench of Justice Govind Mathur and Justice Saumitra Dayal Singh.

As per the facts of the incident, the door of Advocate Rajendra Sharma’s house was broken by the Uttar Pradesh Police and he was dragged from his house and was assaulted and humiliated. He was in his advocate’s dress and the video of that incident also got viral on social media.

After this incident, the Bar Council of India had written a letter to Chief Justice of India SA Bobde and Chief Justice of Allahabad High Court to take immediate steps against the police officer who had assaulted the lawyer.

The Bar Council of India had also pointed out the viral video containing the same. The BCI also pointed out that the incident was ignored by the Yogi Adityanath government.

The BCI while requesting the court to take serious actions has shown concern that if these incidents will be ignored by the judiciary and the government then “Bar will have no option except to come on roads.”

The court’s order ruled

We deem it appropriate to have a complete report of the incident through Chief Judicial Magistrate, Etah. The Chief Judicial Magistrate, Etah is directed to make a necessary inquiry by availing all relevant facts including audiovisual electronic documents and submit to this Court on or before the next date of listing. The District Magistrate, Etah as well as Senior Superintendent of Police, Etah are directed to co-operate the Chief Judicial Magistrate, Etah and they shall supply all relevant facts and documents as desired by the Chief Judicial Magistrate, Etah to furnish a report of the incident to this Court.
