Section 30 of Industrial Disputes Act 1947

Penalty for disclosing confidential information

It provides that any person who willfully discloses any information as referred under Section 21 of the act shall be punishable with imprisonment for a term which may extend up to six months or with a fine extending up to rupees thousand or both upon any complaint made by or on behalf of the trade union or individual business. 

Illustration

A person to take undue advantage leaked confidential information as provided under the act. Further on a complaint by the individual, such a person may be imprisoned for a period exceeding up to six months and fine of rupees one thousand or with both. 

Section 30A of Industrial Disputes Act 1947

Penalty for closure without notice

It provides that any establishment which is closed by the employer without complying with the provisions of section 25FFA shall be punishable with imprisonment for a term which may extend to six months or with a fine which may extend to five thousand rupees or with both. 

Illustration

An employer without following any provisions under section 25FFA closed the establishment. In this case, the person shall be liable for punishment for a term which may extend to six months or a fine which may extend to rupees five thousand or with both.
